Terms of Service

These Terms of Service ("Terms") govern your use of the MVPPrices mobile app and the mvpprices.com website (together, the "Service"), provided by MVPPrices ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Who can use the Service

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You may use the Service only in compliance with applicable laws. You may not use the Service if doing so is prohibited where you live.

2. Your account

You are responsible for the activity that happens on your account and for keeping your sign-in credentials secure. Notify us immediately if you believe your account has been compromised.

You agree to provide accurate information when registering and to keep it up to date.

3. Price information — accuracy and limits

The Service aggregates price data from third-party sources (Kroger, Yelp, EIA, HUD, Rentcast, and others). We work to keep this data accurate but we cannot guarantee that any price shown in the app matches the price you will be charged at the store, pump, restaurant, or property. Prices change frequently and our sources may be out of date.

Always verify the price with the merchant before purchasing. The Service is an information tool only; it is not a transaction platform and we are not a party to any purchase you make based on information shown in the app.

4. User content

The Service allows you to post text, photos, lists, comments, and other content ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it as necessary to operate the Service (e.g., showing your post to other users on the feed).

You represent and warrant that you own or have the necessary rights to all User Content you submit, and that it does not violate any third-party rights or applicable law.

4.1 Prohibited content and conduct

You agree not to use the Service to post or transmit content that:

• Is illegal, harassing, hateful, threatening, defamatory, or invasive of another's privacy.
• Is sexually explicit, depicts minors inappropriately, or promotes violence.
• Infringes anyone's intellectual property rights.
• Contains malware, spam, or commercial solicitation unrelated to the Service.
• Misrepresents your identity or affiliation with any person or organization.

You also agree not to: scrape, crawl, or harvest data from the Service; reverse-engineer the app; bypass rate limits or security controls; or use the Service to compete with us.

We may remove content and suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.

5. Third-party services

The Service links to or relies on services operated by third parties (e.g., Kroger, Yelp, Google, Apple, Cloudflare). Your use of those services is governed by their own terms and privacy policies, not ours. We are not responsible for third-party services.

6. Intellectual property

The Service — including the app, website, logo, branding, design, and all software — is owned by MVPPrices and protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All other rights are reserved.

7. Service changes and availability

We may add, modify, or remove features at any time. We may also suspend or discontinue the Service entirely, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

We work to keep the Service available 24/7 but we do not guarantee uninterrupted access. Maintenance, outages, and third-party failures may cause downtime.

8. Termination

You may stop using the Service and delete your account at any time, in-app or by emailing us.

We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. On termination, sections that by their nature should survive (e.g., disclaimers, limitation of liability, indemnification, governing law) will remain in effect.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF PRICE DATA.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. You use the Service at your own risk.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MVPPRICES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless MVPPrices from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or any law.

12. Governing law and disputes

These Terms are governed by the laws of the United States and the state in which MVPPrices is established, without regard to conflict-of-laws principles.

Any dispute arising from these Terms or the Service will be resolved in the state and federal courts located in that jurisdiction, and you consent to personal jurisdiction there. Where required by local law, you may pursue claims in your local courts.

13. Changes to these Terms

We may update these Terms from time to time. We will post the new Terms on this page and update the "Last updated" date. Material changes will be notified in-app or by email. Your continued use of the Service after changes take effect constitutes acceptance.
